Question:

What are the duties of the Waly? If the two persons are getting married spend time together without a chaperone what are the consequences. If the man has hepatitis b and c what decision can be made on the Waly's part and the potential wife?

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.

It is incumbent upon the guardian to take care of the interests of the woman. He should marry her off only to a qualified, competent and suitable man. He should not oblige her to marry someone she is not willing to marry, whether she is deflowered or an adult virgin according to the preponderant opinion of the scholars. Furthermore, he should not allow her to be in seclusion with a person who proposes to marry her, or to speak to him without any need, or to travel with him.

Allaah knows best.
