Question:

My question is, I am 29-years old Muslim guy from Pakistan. I got married with the acceptance of my parent but my wife's father doesn't accept me because he likes his relative. Kindly say me according to Islam my marriage is legal or not?

Answer:

All perfect praise be to Allaah, The Lord of the Worlds.  I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and Messenger.

The jurists may Allaah have mercy upon them differed in opinion about the ruling on the presence and consent of the guardian of the bride in marriage. The majority of the jurists may Allaah have mercy upon them are of the view that the presence and consent of the guardian of the bride is a condition for the validity of marriage, whereas the Hanafi school does not consider this as a condition for the validity of marriage. The most preponderant opinion in Islamweb’s view is the view of the majority of the jurists may Allaah have mercy upon them as the Prophet, sallallaahu ‘alayhi wa sallam , said: “Any woman, who gets married without the consent of her guardian, her marriage is invalid, her marriage is invalid, her marriage is invalid.

However, if you married her without the presence and consent of her guardian according to a certain school or based on a Fatwa (ruling) of a trustworthy scholar, then the marriage is correct, especially if the marriage is conducted through an Islamic court and the like.

Allaah Knows best.
