Withdrawing the guardianship of the guardian

Question:

I noticed that you make a difference between the man and the woman in marriage as you issued a Fatwa on withdrawing the guardianship of the guardian who refuses to marry off a woman to a man whose religion and moral conduct are pleasing, whereas the man is obliged to obey his parents if they refuse him to marry a woman whose religion and moral conduct are pleasing. Why is it so?

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.

We did not issue a Fatwa with regard to withdrawing the guardianship of the guardian except in case he repeatedly refuses those who propose to marry the woman as this is a sign of preventing her from marrying, and this is something which is prohibited by the text of the Quran.

However, we issued a Fatwa that a son should obey his parents if they refuse him to marry a specific woman, but if this is repeated from them to an extent that it is believed that they do not want him to marry at all, then he is not obliged to obey them. Therefore, there is no contradiction between the two matters.

Allaah Knows best.
