Not mentioning the name of the bride/groom's father during marriage contract

Question

Assalamualikum My question is 'Is the name of the father of the Bride & Groom to be mentioned at the time of Nikah ?' ( if parents are divorced & child has been brought up by any one)& on the day of resurrection we will be know by what names ?(fathers or mothers) Jazakallah

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

It is not a condition to mention one of the parents of the bride or the bridegroom when conducting the marriage contract; rather, what is required is to identify the husband and wife so that there would not be any ambiguity. We have already referred you to Fatwa 90503 which clarifies this matter.

The fact that the parents are divorced does not have any effect on attributing the bride or the bridegroom to them; since this is his/her father and this is his/her mother. If we presume that someone wants to introduce the girl when conducting the marriage contract, then he should say about her: ‘this is (saying her name) …the daughter of so and so (saying her father’s name’. The same can be said about the boy. Besides, it is absolutely forbidden to mention the name of anybody other than the bride/bridegroom’s father even if that person brought him/her up. Allaah The Almighty Says (what means): {Call them by [the names of] their fathers; it is more just in the sight of Allah.}[Quran 33:5]

On the other hand, it should be noted that the fact that the father of the daughter had divorced her mother does not exempt her from his guardianship, and the one who nurtured her is not permitted to be her guardian just because he had brought her up.

Finally, we have already issued Fataawa 19392 and 86110 clarifying that on the Day of Resurrection people will be called by the names of their fathers. So, refer to them.
