Taking commission from an employee who cheats his company

Question

Assalamu alaikum..!I am working in Qatar for a service rendering company. Whereas we supply water for drinking purpose at sites and sewage water removal from site. One of my customer is paying Qrs. 0.08 per gallon for sewage removal from his site, whereas the actual rate in that area is Qrs. 0.065 which our company is making out of this deal. The customer forcibly requested us to quote for Qrs. 0.08 so that he can get a commission of Qrs. 0.015 per gallon. Out of this Qrs. 0.015 i requested the customer to give me Qrs. 0.005 per gallon and the balance of Qrs. 0.01 will be his portion. Whereas my company is aware about the commission what we pay for the customer which is Qrs. 0.015 and they are not aware about my deal with the customer.According to me, I am not cheating my company because i am giving what the company wants and i am getting a portion out of the customers commission, still i am not an ulama or a mufthi to arrive at such conclusion whereas im seeking your help for this matter. I would like to have a fatwa on this matter in order to clarify my doubt which is "Is this commission which i am getting from my customer is haram or halal" Your concern with regards to this is highly appreciated.

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His Slave and Messenger.

It is not permissible for you to participate in cheating with the employee in the site by giving him an invoice that is different from reality in order to take people’s money without right, and then you divide the money between both of you according to the agreement between you.

The fact that your company is aware of the commission does not make such an agreement permissible. Of course, you are not cheating your company, but the cheating is done against the customer's employer while you and your company are acting as accomplices in that cheating.

In brief, what you mentioned is nothing but falsifying the invoices and taking people's money unjustly.
