Sister and her daughter and all her granddaughters are unlawful to marry

Question

What is the ruling on a man marrying the daughter of his sister’s son?

Answer

All perfect praise be to Allaah, the Lord of the worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His Slave and Messenger.

This is an invalid marriage because the sister and her daughter and granddaughters, no matter how far the line of descent goes, are among the prohibited relatives to marry. Allaah The Almighty Says (what means): {Prohibited to you [for marriage] are your mothers, your daughters, your sisters, your father's sisters, your mother's sisters, your brother's daughters…} [Quran 4:23]

The daughters of the sister include every girl who is directly born to the sister or through someone else (granddaughters).

Hence, this marriage is invalid; they should immediately separate from each other. If this marriage was concluded by mistake or forgetfulness, then, this man would be pardoned. The Prophet, sallallaahu ‘alayhi wa sallam, said: “My Ummah is absolved of (the consequences of) anything they do mistakenly, forgetfully, or under coercion.” [Ibn Maajah, Al-Bayhaqi and others]

However, if this act was done deliberately, then, he should turn to Allaah The Almighty in repentance as soon as possible and do good deeds frequently, perhaps Allaah The Almighty would accept his repentance.
