Anal intercourse during Ramadan daytime necessitates strict major expiation

Question

A man had anal sexual intercourse with his wife during daytime in Ramadan. What is the relevant sharia ruling?

Answer

All perfect praise be to Allah, The Lord of the Worlds. I testify that none is worthy of worship except Allah and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and messenger.

There is no doubt that anal sexual intercourse is forbidden by virtue of the Quran and the Sunnah. The Messenger of Allah, sallallahu ‘alayhi wa sallam, cursed its doer in the hadith in which he said: “Cursed is the one who has intercourse with a woman in her anus.” [Abu Daawood and An-Nasaa’i; As-Siyooti and Al-Albaani: Saheeh]

It was also narrated on the authority of Khuzaymah ibn Thaabit  may  Allaah  be  pleased  with  him that the Prophet, sallallaahu ‘alayhi wa sallam, said: “Indeed, Allah is not shy to say the truth (and he repeated it thrice). Do not have sexual intercourse with women (wives) in the anus.” [Ibn Maajah]

It was also narrated that the Prophet, sallallahu ‘alayhi wa sallam, said: “Whoever comes to a diviner and holds him truthful or has intercourse with a woman in her anus or during menstruation has disbelieved in that which was revealed to Muhammad.” [Ahmad, Abu Daawood, An-Nasaa’i, At-Tirmithi and Ibn Maajah with similar wordings; Al-Albaani: Saheeh]

There is no doubt that anal intercourse during the daytime of Ramadan is a huge evildoing and violation of the sanctity of fasting. Fasting is invalid in this case and the doer is required to make up for the missed day along with offering the due expiation. Most scholars did not differentiate between back or front sexual intercourse in this regard. You can review Al-Mughni by Ibn Qudaamah  may  Allaah  have  mercy  upon  him and Haashiyat Ad-Dusuqi and Al-Majmoo‘ by An-Nawawi  may  Allaah  have  mercy  upon  him. The due expiation is obligatory according to the following sequence: Freeing a slave, fasting two consecutive months (if one can not find the first) or feeding sixty needy persons (if one is unable to do the second). Every needy is given a Mudd (volumetric measure equaling about 750 grams) of wheat, raisins or dates.

One is also required to repent to Allah and ask for His forgiveness.
