Wants to use money for daughter's education to meet his own expenses

Question

I am student and I study in European country and I have a scholarship from my country by which I receive a salary every month. And for my daughter they pay the expenses for her to go to school as well. But and because of some personal reasons specially the limit of the money. My family has gone back to my country to stay there. Is it possible for me to take the money from my daughter's school back and spend them on my study expenses, because the life is too expensive and I really need this money to help me to complete my study and to pay the live expenses. The money are not very much 1220 Euro but they really help me.

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.

If this scholarship that is given to you towards the study expenses of your daughter is conditioned upon her being a student in that country where she is a resident, or that the custom is that it is given to her provided she is studying in that country, then the prevalent custom is considered as a condition and therefore you have to meet the requirement of this custom. It is confirmed that the Prophet  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) said: "The Muslims should fulfil their conditions." [Abu Daawood] However, if this scholarship is given to you regardless whether your daughter is studying in the country where she resides or elsewhere, then there is no harm in benefiting from it. Nevertheless, it is most likely that the case applies to the first instance.
