Forbidden from wearing Hijab as a judge's daughter

Question

My sister don't wear Hijaab because my father is judge and it is forbidden to judge's daughters to wear Hijaab or this judge will dismissed from government and father don't want her wear Hijaab she is 18 year, what she can do?

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.

It is mandatory on a woman to wear the Hijab that meets all the conditions of an Islamic Hijab which are mentioned in our Fatwa 83702. It is forbidden for her to obey her father in giving up the Hijab. The Prophet  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) said: "No obedience (to somebody) is allowed in disobeying Allaah." [Ahmad]

The evidences that show Hijab as a duty are mentioned in our Fatwa 83033.

On the other hand, the father should fear Allaah regarding his responsibilities towards his family and regarding his rulings among Muslims. How astonishing that a Muslim father prevents his daughter from wearing Hijab! How can he be a judge for Muslims? It was his duty to impose on his daughter to observe Hijab since the loss of this life is better than the loss of the next life.

Therefore, the father should fear Allaah and should observe the rulings of Islam and should enjoin his family members and Muslims as well to follow Islam. If he can not do so then he has to leave this profession and should seek another job. Allaah Says (which means): {And whoever fears Allaah — He will make for him a way out. And will provide for him from where he does not expect.}[Quran 65:2-3].
