Marriage while woman is in state of minor impurity

Question

Assalaamu alaykum. Can the marriage ceremony be conducted in a state of minor impurity, like due to urine and white discharge? May Allaah reward you.

Answer

All perfect praise be to Allah, The Lord of the worlds. I testify that there is none worthy of worship except Allah and that Muhammad, sallallahu ‘alayhi wa sallam, is His slave and Messenger.

It is permissible to conduct the marriage contract if the bride is menstruating or has had white discharge or urine impurity or the like. The marriage contract conducted in the presence of any such impurity is valid; Ibn Taymiyyah  may  Allaah  have  mercy  upon  him wrote:

"The purpose of the wedding is to make the right of enjoyment lawful. Hence, marriage is only valid when the woman is in a state that allows for such enjoyment, and that enjoyment is not delayed after conducting the marriage contract. Conducting the marriage contract when the woman is in menstruation, postpartum bleeding, or fasting, was made valid because some sort of enjoyment is possible in such a state, or enjoyment becomes possible soon. The fasting person can have such enjoyment at night, and the husband may enjoy his wife without penetrating into her vagina." [Sharh Al-‘Umdah]
