She wants to travel to Egypt without Mahram before making Hijrah to Libya

Question

I have a question conserning making hijra. I am a revert and want to make hijra to Libië with another sister. First we want to go Egypt and stay there for a few months before going to Libië. Is that permissible because we don't have a mahram. Does the waiting periode conclude making hijra or not. Or is it impremissible because we're going to travel twice?

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His Slave and Messenger.

The Sharee‘ah texts state that it is not permissible for the woman to travel alone without a Mahram (i.e. a spouse or a person whom one is permanently prohibited from marrying due to suckling, marital or blood relations), and these texts are mentioned in Fataawa 83795 and 86565. An exception to this ruling is when the woman travels for a necessity, such as making Hijrah (immigration) to a Muslim country. In such a case, it is permissible for the woman to travel without a Mahram if it is difficult for her to find one.

Hence, if your travel is for a necessity to save your religion and you cannot find a Mahram, it is permissible for you to travel without a Mahram.

However, it is known that necessity should be measured according to its proper value. So, if your travel to Libya does not require you to pass by Egypt for a necessity or a need, it will not be permissible for you to pass by it and thence travel to Libya without a Mahram, because there is no necessity for that travel since Egypt is also a Muslim country.
